Terms of Service

By using nerdwaretech.com (the "Site"), you agree to these Terms of Service and to our Privacy Policy. If you are using the Site on behalf of a company, you confirm that you are authorised to accept these terms for it. If you do not agree, please do not use the Site.

The Site describes NerdWare Tech's services, including AI and business automation, custom software products and e-commerce storefront development. Content on the Site is for general information only and is not an offer to provide services on particular terms.

Any project we take on will be covered by a separate written proposal, statement of work or agreement. If that agreement conflicts with these terms, the agreement takes priority. Quotes and initial assessments are free and non-binding until both parties sign.

When using the Site, the contact form or the live chat, you agree not to:

• break any law or infringe anyone else's rights;
• send spam, malware, or false or misleading information;
• try to gain unauthorised access to the Site, its servers or connected systems, or disrupt how they work;
• scrape, copy or harvest the Site's content or data using automated means; or
• impersonate any person or organisation.

The Site and its content, including text, graphics, logos, designs and code, belong to NerdWare Tech or its licensors and are protected by intellectual property laws. NerdWare Tech® and our product names are our trademarks. You may view and share pages for personal or internal business purposes, but you may not copy, modify, distribute or use the content commercially without our written permission.

Ownership of work we produce for clients is set out in the relevant project agreement.

You are responsible for what you send through the contact form, chat or email, and you confirm you have the right to share it. We handle it as described in our Privacy Policy. Please do not send confidential information until we have agreed on confidentiality terms. We are happy to sign an NDA before detailed discussions.

The Site links to websites we do not control, and to our own products, such as VirtualTry.shop and Lookscraft, which have their own terms. We are not responsible for third-party sites or their content. Your use of our products is governed by the terms published on each product's site.

The Site is provided "as is" and "as available". To the fullest extent the law allows, we make no warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy or non-infringement. We do not promise that the Site will always be available, error-free or secure. Case studies, figures and examples on the Site show past results and do not guarantee future outcomes.

To the fullest extent the law allows, NerdWare Tech and its team will not be liable for any indirect, incidental, special, consequential or punitive damages, or for loss of profits, revenue, data or goodwill, arising from your use of the Site. Our total liability for any claim related to the Site is limited to one hundred US dollars (US$100). Nothing in these terms limits liability that cannot be limited by law.

You agree to indemnify and hold harmless NerdWare Tech from any claims, losses or expenses, including reasonable legal fees, that result from your misuse of the Site or your breach of these terms.

These terms are governed by the laws of the State of Wyoming, United States, without regard to its conflict-of-law rules. Any dispute will be resolved exclusively in the state or federal courts located in Wyoming, unless the law of your place of residence gives you the right to bring a claim elsewhere.

We may update these terms from time to time. The "last updated" date at the top of this page shows when they last changed. If you keep using the Site after a change, you accept the updated terms. If any part of these terms is found unenforceable, the rest still applies.
